1. BACKGROUND INFORMATION
1.1
These general terms and conditions ("General Terms") apply to you when you place an order as a consumer ("Customer") via the address www.aquaction.fi. The General Terms and Conditions apply only to consumer customers.
1.2
The Customer must be at least 18 years of age to place an order through the Website. Aquaction reserves the right to reject or modify the Customer's order (e.g. if the Customer has provided false personal information and/or has an entry in their credit file).
1.3
Aquaction shall not be liable for any compensation if the Products are sold out or if the Website contains errors in illustration or printing (e.g. errors in product descriptions or technical information), incorrect prices and price adjustments (such as prices changed by suppliers and currency changes) or incorrect information about the stock status of the Product. Aquaction reserves the right to correct any such errors and to change or update the information at any time. If an incorrect price has been quoted for a product ordered by a customer, Aquaction will of course notify the customer and wait for the customer to accept the corrected price before Aquaction proceeds with the order process.
1.4
The Website and all content on the Website is the property of Aquaction or its licensors. The information is protected by intellectual property and marketing laws.
2. CONTRACTS AND ORDERS
2.1
The customer must accept the general terms and conditions in order to place an order via the website. By accepting the General Terms and Conditions, the Customer undertakes to comply with the General Terms and Conditions in their entirety and confirms that he has read the information.
2.2
The purchase contract is concluded when Aquaction has confirmed the Customer's order and the Customer has received an order confirmation by e-mail from Aquaction.
3. CUSTOMER INFORMATION
3.1
The customer confirms that the information provided is correct and complete and is responsible for any errors in the information provided. Information on how Aquaction processes personal data is provided on this website in the Privacy Policy, which forms an integral part of these General Terms and Conditions.
3.2
The Customer undertakes to ensure that no one other than the Customer itself uses the Customer's login details. The Customer shall not disclose its username or password to anyone and shall ensure that all documents containing username and password information are stored in a manner that prevents unauthorised persons from accessing them. The Customer shall notify Aquaction immediately if he suspects that an unauthorised person has access to the Customer's password. The Customer is responsible for all purchases made with his/her login credentials if the Customer has not made the aforementioned notification.
3.3
If Aquaction suspects that the Customer is misusing his/her user account or login credentials or otherwise violating the General Terms and Conditions, Aquaction has the right to deny the Customer access to his/her user account. In addition, Aquaction has the right to assign new login credentials to the customer.
4. PRICES, COSTS AND FEES
4.1
The prices indicated on the website apply only to orders placed on the website. All prices are quoted in Euro and include VAT. Prices do not include payment and delivery charges, which are indicated separately.
5. SPECIAL OFFERS
All offers on specific products on the website are valid for a limited period only or until the products are sold out.
6. DELIVERY AND SHIPPING
6.1
Products in stock are usually delivered within the working days indicated on the website. Unless otherwise agreed (e.g. when booking products that are not in stock), delivery will take place within 30 working days of the order being confirmed in writing by Aquaction by means of an order confirmation.
6.2
The estimated delivery time will be indicated on the order confirmation, at checkout and/or on the website on the relevant product page. Unless otherwise expressly agreed and if delivery is delayed for more than 30 working days for reasons beyond the control of the customer, you have the right to cancel your purchase.
6.3
If the package has to be picked up from a specific delivery location, the customer will pick it up within the time specified in the notice. Parcels are usually collected in person, using a valid ID and order number. The customer will receive a delivery notification specifying when and where the parcel can be picked up or received. The notification may be sent by e-mail, regular mail and, if the customer has provided a mobile phone number, by telephone or SMS. If the parcel is not collected, Aquaction is entitled to charge the costs incurred 14,95 € from the customer.
7. RIGHT OF CANCELLATION
7.1
When purchasing products from the website, the customer has a 14-day cancellation period in accordance with applicable consumer legislation. This means that the customer has the right to cancel any purchase by notifying Aquaction within 14 days of receipt of the ordered product by the customer or his representative (the "Cancellation Period").
7.2
The Cancellation Right does not apply to the following products:
(a)
products manufactured to customer specifications or otherwise clearly identified;
(b)
products whose seals have been broken may not be returnable for health or hygiene reasons.
(c)
products that perish or expire quickly;
7.3
By accepting these General Terms and Conditions, the Customer understands and agrees that the right of withdrawal does not apply in the above cases.
7.4
If the Customer orders a product for which the right of withdrawal does not apply, the Customer will be clearly informed.
7.5
If the Customer wishes to cancel a purchase, the Customer must send a clear message to Aquaction before the end of the cancellation period. In the message, the customer must provide his/her name, address and other relevant information, such as order reference, invoice number and product name. If the customer does not wish to use the above alternative message, he can use the standard form for the right of withdrawal of the National Competition and Consumer Authority (see link at http://www.kkv.fi/)
7.6
If the customer exercises his right of withdrawal, he will pay the return costs and will be responsible for the condition of the product after receipt and during the return transport. The product must be returned within 14 days of the date on which Aquaction was informed of the cancellation. The product must be sent well packaged, in good condition and in its original box and/or packaging.
7.7
Aquaction may at any time offer free returns on certain products. If a free return is applicable, this will be indicated on the website, on the relevant product page.
7.8
When the customer cancels their purchase, Aquaction will refund the amount the customer has paid for the product, including delivery charges. If only part of the order is returned, we will charge €6.95 for the costs incurred for this return.
7.9
Aquaction will refund the amount without undue delay, but no later than 14 days from the date Aquaction received the product. Unless otherwise agreed or there is an impediment to such repayment, the repayment will be made to the customer using the payment method of the customer's choice.
8. WARRANTIES AND COMPLAINTS
8.1
Certain Aquaction products may be covered by a warranty. Product warranties only cover manufacturing defects and therefore do not cover any defect resulting from any single change in the function or appearance of the product. The customer's order confirmation will serve as proof of warranty.
8.2
The right of complaint applies to products that are defective under applicable consumer protection laws. A customer wishing to exercise his right to complain about a product should contact Aquaction as soon as possible after discovering the defect, using the contact details provided on the website. Complaints made by the customer within two months of the discovery of the defect will always be deemed to have been made within the appropriate timeframe. The Customer has the right to make a complaint about products purchased from the Website within a reasonable time after receipt of the product.
8.3
Aquaction will be responsible for the cost of transporting any returns resulting from accepted complaints.
8.4
In relation to complaints Aquaction will follow the guidelines issued by the Consumer Disputes Board (see www.kuluttajariita.fi ).
9. LINKS
Aquaction may provide links to other websites which are not under the control of Aquaction. Websites not under the control of Aquaction may also provide links to the Website. While Aquaction strives to ensure that Aquaction only provides links to websites that comply with the privacy and security provisions of the Aquaction Privacy Policy, Aquaction is not responsible for the security or confidentiality of any information or personal data that you provide on other websites. The customer should exercise caution and read the personal data protection regulations that apply on that website.
10. EXCLUSIVE REMARKS
Aquaction shall not be liable for any delay or cancellation of an order due to circumstances beyond Aquaction' s reasonable control. These include, but are not limited to, general labour disputes, acts of war, fires, lightning, terrorist attacks, changes in government regulations, technical problems, faults in power/telecom/computer connections or other communications, and faults and delays in services provided by subcontractors due to the aforementioned circumstances. In such circumstances, the obligation to pay damages and take other measures shall lapse. If such a situation arises, Aquaction will inform the customer both at the beginning and at the end of the situation. If the situation has lasted for more than two months, both the customer and Aquaction have the right to suspend the purchase with immediate effect.
11. CHANGES TO GENERAL TERMS AND CONDITIONS
Aquaction reserves the right to change these general terms and conditions at any time. Any changes to these General Terms and Conditions will be published on the website. Changes will take effect once the customer has accepted the general terms and conditions (at the time of a new purchase or when browsing the website).
13. APPLICABLE LAW AND DISPUTE RESOLUTION
13.1.
In case of dispute, Aquaction will comply with the decisions of the Finnish National Consumer Disputes Board or similar authorities in other European countries.
13.2
All disputes concerning the interpretation or application of these General Terms and Conditions shall be governed by and construed in accordance with Finnish law and shall be settled by the courts of Finland at the latest.
